née provides artificial intelligence-generated audio workout coaching for informational and educational purposes only. It is not medical advice. You should always consult a qualified physician or healthcare provider before beginning any new exercise routine.
1. Acceptance of Terms
By downloading, accessing, or using the née mobile application ("the App") or related services provided by Hjarta Limited ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.
2. AI-Generated Fitness Coaching
The App utilizes automated algorithms, large language models (LLMs), and synthetic speech technologies to generate dynamic workout pacing and audio coaching.
- No Human Vetting: Custom audio segments are generated dynamically and are not reviewed by human personal trainers in real time.
- Assumption of Risk: Exercise carries inherent physical risk. You assume full responsibility for assessing your safety, environment, and physical limits while following any workout plan.
3. Apple Health & HealthKit Integration
With your permission, née connects to Apple Health (HealthKit) to read heart rate and calorie metrics during your workouts.
Privacy Guarantee: We do not use, share, or sell HealthKit data to third parties for advertising, marketing, or data mining purposes. HealthKit data is never used to train public AI models.
4. Subscriptions and Billing
Certain features, including custom AI audio generation, require a paid subscription ("Pro Immersion").
- In-App Purchases: Subscriptions are processed through Apple's App Store via RevenueCat. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Cancellation: You can manage or cancel your subscription at any time via your iOS Settings > Apple ID > Subscriptions.
- Restoring Purchases: You may restore previous purchases using the "Restore Purchases" button on the app's paywall.
5. Location & Route Tracking
To track outdoor running routes, measure pace, and calculate distance, the App requests permission to access your device’s GPS location. Location tracking occurs only during active workout sessions and can be disabled in your device settings.
6. Account Deletion & User Data
You may request deletion of your account and personal data at any time directly within the App under Profile > Manage Account > Delete Account. Upon confirmation, your data will be permanently purged in accordance with our Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Hjarta Limited shall not be liable for any personal injury, direct, indirect, incidental, or consequential damages resulting from your use of or inability to use the App.
